The Organiser

The Client
The person making a booking through the website habibicometoitaly.com, identified by the data (first name, last name, email) provided at the time of booking, hereinafter "the Client".
1.1 This contract governs the sale, by the Organiser to the Client, of a tourist experience in Tuscany (hereinafter "the Experience"), with the characteristics, date, duration and price indicated on the experience page published on the website at the time of booking.
1.2 The specific characteristics of the purchased Experience (date, duration, meeting point, formula, price, number of participants) are those indicated on the experience page and summarised to the Client at the time of booking. In case of discrepancy, the details stated in the booking confirmation email shall prevail.
2.1 This contract is deemed concluded and fully accepted by the Client at the moment the deposit referred to in Art. 3 is paid.
2.2 Payment of the deposit constitutes full and unconditional acceptance of this contract, and confirms that the Client has read, understood and accepted all the terms contained herein. No further formal signature is required.
2.3 At the moment the deposit is paid, the system records the date, time and IP address from which acceptance took place, together with the version of this contract accepted by the Client, for evidentiary purposes.
3.1 Deposit: at the time of booking, the Client is required to pay a deposit, the amount or percentage of which relative to the total price is indicated on the experience page. Payment is made by credit/debit card through the secure payment system indicated on the website.
3.2 Balance: the balance of the price must be paid by the Client no later than 2 (two) days before the start date of the Experience, via the personal payment link sent by email after the deposit is confirmed.
3.3 Failure to pay the balance: should the Client fail to pay the balance within the term indicated in point 3.2, the Organiser will send a final reminder, setting a short final deadline for payment. Should this deadline also pass without payment, the booking will be automatically cancelled, and the deposit paid will be retained as a penalty.
4.1 Withdrawal more than 30 days before the start of the Experience: the Client has the right to withdraw from this contract by notifying the Organiser at least 30 (thirty) days before the start date of the Experience. In this case, the Organiser will retain, as a penalty to cover organisational costs already incurred, an amount equal to 10% (ten per cent) of the total price of the booked Experience (not of the deposit paid, but of the overall price of the Experience). Any amount paid in excess of this penalty will be refunded to the Client.
4.2 Withdrawal within 30 days of the start of the Experience: in the event of withdrawal notified by the Client less than 30 (thirty) days before the start date of the Experience, the Organiser reserves the right to retain the entire deposit paid as a penalty, to cover organisational costs already incurred.
4.3 Exceptional circumstances: in the event of exceptional and documented circumstances (force majeure, serious and documented health reasons, etc.), the parties agree to consider in good faith alternative solutions, such as rescheduling the Experience to a later date, instead of applying the penalties described above.
4.4 How to notify withdrawal: notice of withdrawal must be sent to the email address ciao@habibicometoitaly.com. Withdrawal is deemed received at the moment the Organiser replies with an email confirming receipt. The date and time of that confirmation email shall be determinative.
5.1 Should the Organiser be forced to cancel the Experience for reasons attributable to the Organiser or due to force majeure (e.g. adverse weather conditions, failure to reach the minimum number of participants, unforeseen unavailability), the Client is entitled to a full refund of all amounts paid, with no deduction whatsoever.
5.2 The Organiser undertakes to notify the Client of any cancellation as soon as possible, and in any case as soon as the cause of the cancellation becomes known.
6.1 The price of the Experience includes the services indicated as such on the experience page published on the website at the time of booking.
6.2 Travel expenses to reach the indicated meeting point are not included.
The processing of the Client's personal data is carried out in accordance with the Privacy Notice, available on the website, which the Client declares to have read at the same time as accepting this contract.
8.1 This contract is governed by Italian law.
8.2 The Court of Florence (Foro di Firenze) shall have exclusive jurisdiction over any dispute relating to this contract.
